'Hackintosh' vendor wins legal right to challenge Apple's EULA
Apple is facing the real possibility that it may have to allow the installation of its OS X operating system on non-Mac computers, after a judicial ruling on Friday said it does have a case to answer to.
The ruling means 'Hackintosh' vendor Psystar can continue its countersuit against Apple. The trial, which resumes on November 9th this year, could result in Apple being forced to allow firms such as Psystar, as well as PC vendors HP, Dell and Acer to produce computers running the operating system.
Psystar's case hinges on its claim that Apple abuses copyright laws by insisting that its software – including crucially is operating system – can only be installed on Apple manufactured equipment.
Speaking at the ruling, Judge Alsup said: "Psystar may well have a legitimate interest in establishing misuse independent of Apple's claim against it, for example, to clarify the risks it confronts by marketing the products at issue in this case or others it may wish to develop."
In the meantime, Psystar will be allowed to continue selling its clones.
